BiH Parliament adopts laws on border control and personal data protection

The House of Peoples of the Parliamentary Assembly of Bosnia and Herzegovina has adopted, in an urgent procedure, the Draft Law on Border Control and the Draft Law on Personal Data Protection. These laws play a key role in regulating the border regime and data protection, representing an important step toward Bosnia and Herzegovina's European integration.

Law on Border Control

The draft law, proposed by the Council of Ministers of BiH, was adopted with 11 votes in favour and four against. Six delegates from the Federation of BiH voted in favor, and four against, while all five delegates from the Republika Srpska entity supported the proposal.

During the discussion, the Head of the Bosniak Caucus, Sefik Dzaferovic, emphasized that this law is of great importance as it regulates the regime for crossing the state border of BiH. It is also one of the key conditions for the country's further European integration.

Law on Personal Data Protection

The House of Peoples also adopted the principles of the Draft Law on Personal Data Protection of BiH, which was also proposed by the Council of Ministers. All 14 present delegates voted in favour of this proposal.

Following the emergency session, the amendment phase for the Draft Law was opened, lasting one hour. The Constitutional Committee will review the draft during this phase and submit its opinion to the House of Peoples. After that, another emergency session will be held, where delegates will consider the draft in its second reading (amendment phase).

The Draft Law on Personal Data Protection was also adopted by the House of Representatives last week, with 14 amendments. The aim of this Law is to align with the EU Regulation from 2016 on the protection of individuals regarding the processing of personal data and the free movement of such data, while adopting internationally recognized standards in this field.

Significance for BiH

The adoption of these two laws represents an important step in strengthening Bosnia’s legal framework, particularly in the context of European integration. The Law on Border Control ensures better regulation of the border regime, while the Law on Personal Data Protection introduces high standards of data protection, which is crucial for future cooperation with the European Union. These moves demonstrate BiH's commitment to reforms and alignment with European standards.
